Elizabeth has included trusts as an area of practice throughout her career and continues to do so. Recent work has included advice on trustees’ conflicts of interests, an alleged constructive trust arising on the purchase of a property and the effect on the beneficial interests of a subsequent mortgage negotiated in part by a beneficiary not on the legal title and consideration of the effect of s32 of the Trustee Act 1925 in the context of the release of a prior life interest. Much of Elizabeth’s pensions work also involves a thorough understanding of the underlying trust law.
