The expertise of members of Radcliffe Chambers extends to trusts administered in or governed by the laws of overseas common law jurisdictions.
Some of our members have gained valuable experience working on secondment in law practices in offshore jurisdictions, and we have three honorary members who practise overseas.
Contentious trust matters with overseas elements that our members have dealt with include breach of trust claims, trustees’ indemnities, claims against trust property arising out of matrimonial proceedings, trustees’ applications for directions, rights of beneficiaries to information about trust affairs, and the registration and recognition of judgments.
In the non-contentious field, members have drafted and advised on a wide variety of settlements, appointments and other trust instruments for use in overseas common law jurisdictions. Examples of such work are the review of standard trust documentation for an international trust company, and advice on the transfer of trusts between jurisdictions.
