Dunsfold School: Decision of the Charity Tribunal

Mark Mullen represented the successful Appellants before the First-tier Tribunal (Charity) in a case concerning a challenge to a cy-près scheme made by the Charity Commission for a charity holding land and buildings which had been used for the purposes of a school from 1839 until the school’s closure in 2004.

Marcus Flavin appeared for the claimants in an application under the Variation of Trusts Act 1958 for the court’s approval of a variation of statutory trusts in favour of an infant arising on two successive intestacies.


Judgment in Killearn v Killearn [2011] EWHC 3775 (Ch)

Hedley Marten and Daniel Burton appeared for the First and Fourth Defendants respecitvely in the Claimant’s application to sell 17th century Haremere Hall, in Etchingham, Sussex, which is currently held in a family trust.


Decision in the Independent Schools Public Benefit Case

The Upper Tribunal (Tax and Chancery Chamber) has today released its decision in R (Independent Schools Council) v The Charity Commission for England and Wales and HM Attorney General v The Charity Commission for England and Wales [2011] UKUT 421 (TCC).

Alexander Forbes Trustee Services Ltd. v John Doe & Richard Roe

On 5 September 2011 in the High Court in Birmingham Keith Rowley QC appeared for the well known litigant Richard Roe at a hearing to determine how regulation 13 of the Occupational Pension Schemes (Winding Up) Regulations 1996, SI 1996/3126, affects the application of money purchase assets on the winding up of two hybrid pension schemes.


Judgment in Houldsworth v Bridge Trustees [2011] 1 WLR 1912

The Supreme Court today handed down its judgment in Houldsworth v Bridge Trustees Ltd (the Imperial Home Décor Pension Scheme). Keith Rowley QC appeared for the trustee of the scheme.
