Robert Pearce QC and Mark Thomson act for successful Defendant in Power v Open Text

Judgment was delivered today, 7th December 2009, in Power v Trustees of the Open Text (UK) Limited Group Life Assurance Scheme.

The claim was brought by the beneficiary of a group life assurance scheme to whom a death-in-service benefit had become payable. The claimant alleged that the trustee of the scheme had been in breach of duty by failing, following the reforms introduced on “A Day” in April 2006, to take steps which would have led to the removal of the “earnings cap” on benefits payable under the scheme. That claim failed, as did a further claim for compensation for delay in payment of the “capped” benefit.
