Ilford Pension case to go to Court of Appeal

On 15 February 2010 Rimer LJ granted permission to appeal in Independent Trustees Services Ltd v Hope & Ors [2009] EWHC 2810 (Ch), the test case concerning the Ilford Pension Scheme in which Keith Rowley QC acts for the appellant member.

Rimer LJ granted permission on the grounds that the appeal has a real prospect of success, as well as raising issues of general importance.

The central issue in the case is whether trustees owe any duties to the Pension Protection Fund prior to a scheme entering into an assessment period and to what extent they should take its interests into account when exercising their discretionary powers.
